Phototory turns photographs into an itemized inventory with estimated values. It is a starting point for your own records, your accountant, or your insurer — not a professional valuation. These terms explain what you get, what you are responsible for, and what happens to your data.
1. These terms
These terms are an agreement between you and Deeko Global LLC, an Ohio limited liability company, which operates Phototory ("Phototory", "we", "us"). Our address is PO Box 37, Mason, OH 45040, United States. They apply whenever you use the site, upload a photograph, or buy a report.
If you do not agree with them, do not use the service. If you are using Phototory on behalf of a company or other organization, you confirm you are authorized to accept these terms for it.
Phototory is offered to people in the United States. We do not currently market or offer the service elsewhere, and these terms are written for the United States.
You must be at least 18 years old to buy a report or hold an account.
2. What Phototory is, and what it is not
You upload photographs of a room or property. Phototory identifies the furnishings, appliances, decor and fixtures visible in them, and produces an itemized list with an estimated value for each item, split into personal property and building components. You receive the results on screen and as a downloadable PDF.
Phototory is not a valuation, an appraisal, a cost segregation study, an insurance determination, or tax advice, and it is not a substitute for a qualified professional. No physical inspection is performed and nobody visits the property.
The output is a starting point. You are responsible for reviewing it and for any decision you make on the basis of it, including anything you file with a tax authority or submit to an insurer.
3. Estimated values
Every value shown is a generalized figure for an item of the type and quality identified. It is not an assessment of your particular item. It does not reflect condition, age, wear, provenance, brand, rarity, local market conditions, or what the item would actually sell for.
Two identical-looking items in the same photograph will carry the same estimate even if one is damaged and the other is new, because condition is not assessed at all.
Where an item could not be identified confidently, or could only be valued as a general estimate rather than a specific match, the report flags it for review and reports its value separately from the rest. Those flags are part of the product, not a defect in it.
4. Personal property and building components
Reports separate movable personal property and furnishings from building components such as cabinetry, countertops, flooring, and plumbing or electrical fixtures.
This separation is descriptive. Building components are structural, and Phototory does not determine whether any item is eligible for reclassification, depreciation, or any particular treatment. Suggested asset classes shown in a report are illustrative and must be confirmed by a CPA or cost segregation engineer before use.
5. Your photographs
You keep ownership of everything you upload. You grant us permission to store and process your photographs, and to have our service providers do so on our behalf, only to produce, deliver and re-deliver your report, and only for the retention period described below. That permission ends when the photographs are deleted.
You confirm you have the right to upload each photograph, and that doing so does not infringe anyone else's rights or breach anyone's privacy. Do not upload photographs of a property you have no connection to, and do not upload images whose main subject is a person.
We do not sell your photographs, publish them, use them to advertise the service, or use them to train any model.
6. The free sample
You can upload one photograph without an account or payment. The sample is deliberately limited: only the first few lines are shown in full, the remaining detail and all monetary totals are withheld, and the PDF is watermarked.
Nothing in a free sample is invented to fill the gap. Withheld figures are withheld, never substituted with made-up numbers.
7. Buying a report
Reports are sold as a one-time purchase, priced by the size of the property rather than by the photograph. Your batch falls into a size band, and every band has one flat price that covers all the photographs it allows. Adding another photograph within your band costs nothing.
The band, the price and the number of photographs included are all shown before you pay, and the amount charged is the amount you were shown.
Payment is handled by Stripe. We never receive or store your card details. Prices are in US dollars and do not include sales tax. Any tax due is calculated at checkout from the billing address you give, shown to you before you pay, and added to the total.
You do not need an account to buy a report. We ask for an email address so we can send you the download link — for a guest purchase, that link is the only route back to your report.
Photographs are analyzed after payment is confirmed. A report is usually ready within a few minutes; you can close the page while it finishes and use the emailed link when it arrives.
8. Refunds
A report is a digital product that is produced for you on purchase, so it is not returnable once generated.
If a report is not produced, is materially incomplete because of a fault on our side, or is never delivered, tell us within 30 days and we will regenerate it or refund it in full. That choice is yours, not ours.
We do not refund a report because you disagree with the estimated values in it. Those values are generalized figures, section 3 explains exactly what they are and are not, and a report that flags its own uncertain lines is working as described.

9. Extended storage
Extended storage is a separate, recurring subscription tied to an account. It keeps your reports and the photographs behind them available for as long as it is active, instead of the default 30 days.
It is billed monthly at the price shown when you subscribe, plus any sales tax due, and it renews automatically each month until you cancel. We will tell you before any price change takes effect. Tax is recalculated on each renewal, so the amount charged can change if the rate where you live changes.
You can cancel at any time, without contacting us, from the billing portal linked in your account. Cancellation takes effect at the end of the period you have already paid for; we do not refund part of a month.
Cancelling does not delete your data immediately. A 30-day period runs from the cancellation date, after which the data is deleted as normal.
Extended storage is a storage service only. It does not include new reports, and buying it changes nothing about reports you have already purchased other than how long they are kept.
10. How long we keep your data
Photographs and generated reports are deleted 30 days after upload, and erased within 37.
If an active extended-storage subscription is attached to the account that owns them, they are kept for as long as that subscription runs.
If that subscription is canceled or lapses, a 30-day period runs from the cancellation date, and the data is deleted at the end of it on the same terms.
Deletion is real and permanent. At 30 days the photographs, the generated PDF and the underlying record are removed and the report can no longer be reached; the stored files are held for up to 7 days more so an accidental deletion can be undone, and are then erased. We cannot restore a report once that has happened. Download anything you want to keep.
11. Accounts
An account is optional and is offered after purchase. It exists so you can find and re-download past reports and hold an extended-storage subscription.
Signing in works by emailed link rather than a password. Anyone with access to your email account can therefore sign in as you; keep it secure. Sign-in links expire shortly after they are sent and can only be used once.
When you first sign in, reports you bought as a guest using the same email address are attached to your account automatically.
12. Acceptable use
Do not use Phototory to break the law, to infringe anyone's rights, or to upload content you have no right to upload.
Do not attempt to disrupt the service, bypass its limits, scrape it, or use automated means to access it beyond ordinary use of the site.
We may suspend or refuse service where these terms are being breached.
13. Our content
The site, the software behind it, and the format and presentation of the reports it produces belong to us or our licensors.
The report generated from your photographs is yours to use, keep, and share — including with your accountant, insurer, or adviser. You may not resell Phototory reports as a service of your own or use the service to build a competing product.
14. Availability
We aim to keep Phototory available and working, but we do not promise uninterrupted service. Maintenance, third-party outages and faults happen.
If a report you paid for cannot be produced because of a fault on our side, section 8 says what we will do about it.
15. Changes
We may change the service and these terms. If a change materially affects your rights, we will give at least 30 days notice before it takes effect — by email where we have your address, and on the site.
Changes do not apply retroactively to a report you have already bought. If you do not accept a change, stop using the service and cancel any subscription before it takes effect.
16. Disclaimer of warranties
PHOTOTORY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY, OR FITNESS FOR ANY PURPOSE OF ANY ITEM IDENTIFICATION, ESTIMATED VALUE, CLASSIFICATION, OR SUGGESTED ASSET CLASS IN ANY REPORT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Some states do not allow the exclusion of certain implied warranties, so parts of this section may not apply to you. Nothing in these terms limits any liability that cannot lawfully be limited, and this section does not affect any right you have under section 8 to a refund or a regenerated report.
17. Limitation of liability
To the fullest extent permitted by law, our total liability to you arising out of or relating to the service, whatever the legal theory, will not exceed the greater of the amount you paid us for the report the claim relates to, or fifty US dollars.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or lost business — including tax outcomes, audits, penalties or interest, denied, reduced or underpaid insurance claims, and any decision taken in reliance on an estimated value.
These limits are a basic part of the deal between us. A report costs a small fixed amount and may be used to support a position worth far more, and the price of the report is set on the understanding that we do not carry that larger risk. You carry it, which is why sections 2 and 3 are written as plainly as they are.
Some states do not allow the limitation or exclusion of certain damages, so parts of this section may not apply to you.
18. Indemnity
You agree to indemnify and hold harmless Deeko Global LLC and its members, officers and employees from any third-party claim, loss, liability, or expense, including reasonable attorney fees, arising out of a photograph you uploaded without the right to do so, your breach of these terms, or your use of a report.
We will tell you promptly about any claim we seek indemnity for, and you may control its defense provided you do not settle it in a way that imposes any obligation on us without our agreement.
19. Ending your use
You can stop using Phototory at any time, cancel a subscription from your account, or ask us to delete your data.
We may suspend or end access where these terms are breached, or where we are required to.
Sections 3, 5, 13, 16, 17 and 18 survive the end of your use of the service.
20. Governing law and disputes
These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules.
Any dispute arising out of or relating to these terms or the service will be brought exclusively in the state or federal courts located in Warren County, Ohio, and you and we each consent to the personal jurisdiction of those courts.
If you live in a state whose consumer-protection laws give you rights that this section would otherwise take away, those rights still apply to you.
Before filing anything, please contact us. Most disputes about a report are resolved faster by telling us what went wrong.
21. General
These terms, together with the Privacy Policy, are the entire agreement between you and us about the service.
If any part of these terms is found unenforceable, the rest continues to apply and the unenforceable part is limited only as far as necessary.
Our not enforcing a term on one occasion does not waive it. You may not transfer these terms to anyone else; we may transfer them to an affiliate or to a buyer of the business.
